One of the very important branches of government at every level, is the judicial system, the system dedicated to providing all people fair treatment under the law.
The task of determining fairness is extremely difficult. What is "fair" for one individual in a specific situation is not always "fair" for another in a different situation. For example, the law is specific regarding driving at an excessive speed. A speed limit is easy to understand. Easy to recognize when it is violated.
If a nervous father is driving carefully but exceeding the speed limit as he rushes his pregnant wife to the hospital because their first born is beginning to make an appearance in this world, should he be fined? He is violating the law! A police officer, once the situation is understood, in most cases, provides siren and red lights to help the couple exceed the speed limit to rush to the hospital.
Laws are to be administered by judges who possess a large quantity of common sense, as well as a command of the law and an understanding of the community or area they serve.
The judicial system by design is an adversarial arena, a forum where all parties may present information for an impartial party to make a final determination in a contested matter. The laws lay the groundwork for progressing through this adversarial system. Laws give us the rules of operation. We diligently protect the integrity of these laws to provide all parties in a case a fair opportunity to utilize this forum.
